Swimming Pool Accidents

In 2014, Florida Health reported that 43 children died in Miami-Dade County as the result of unintentional drowning. Another 48 were hospitalized as a result of a non-fatal drowning, and an additional 53 were treated at an emergency department.

Swimming pool accidents most commonly take place in country clubs, community pools, hotels, motels, private pools, and water parks. As a general rule, pool owners are responsible for the safety of the pool users. More specifically, pool owners and/or operators have a duty to reasonably protect small children from drowning, especially when the owner knows that children are likely to be around the pool.

Most swimming pool accident cases are the result of either a supervisor failing their duties, faulty gates, faulty drains, or other hazards endangering a swimmer who has entered an area that should have been restricted, or any combination thereof. A swimming pool owner may be held responsible in a swimming pool accident case even if they are not in violation of any code or law.
