Negligent Security

Under Florida law, landowners have a duty to provide people on their property with competent security that will prevent predictable injuries and damages caused by third parties. When a landowner fails this duty, they may be held responsible for their failure under a cause of action for Negligent Security.

Negligent Security cases take place when a landowner fails to provide competent security that is either (1) required by law or (2) would prevent a foreseeable injury and/or damage by a third person, and people on their property suffer injuries and/or damages as a result thereof. The most common Negligent Security cases are robberies and attacks that take place in parking garages, apartment complexes, and shopping malls.
